Terms & Conditions and liability waiver
By booking, purchasing, or participating in services offered by French Commute, you acknowledge that you have read, understood, and agreed to the following Terms & Conditions and Liability Waiver.
By checking the acceptance box during booking or checkout, you agree to be legally bound by these Terms & Conditions.
1. Nature of the Service
French Commute provides pre-arranged transportation combined with conversational French language practice during scheduled rides.
French Commute is not an on-demand rideshare platform. All rides must be scheduled in advance through our booking system.
Participation in French Commute services is voluntary.
2. Eligibility
Clients must be at least 21 years old to book and participate in French Commute services.
Clients agree to provide accurate booking information, including pickup and drop-off locations.
3. Booking & Session Packages
French Commute operates exclusively through prepaid session packages and pre-arranged bookings.
Clients may select the package that best fits their needs during checkout.
Purchased sessions are associated with the client’s Member Page and are non-transferable unless otherwise approved by French Commute.
Clients are responsible for reviewing their Member Page to monitor upcoming rides, past rides, cancellations, and remaining sessions.
4. Ride Duration
French Commute sessions are designed for rides of up to 30 minutes.
Session time begins at the scheduled booking time, regardless of the client’s arrival time at the pickup location.
Traffic conditions, route changes, weather, and other external circumstances may affect total ride duration.
French Commute does not guarantee exact arrival times.
5. Wait Time Policy
French Commute allows a maximum wait time of 10 minutes at the pickup location.
If the client is not present within 10 minutes of the scheduled booking time, the ride may be considered canceled, and the booked session may be deducted from the client’s package.
6. Cancellation & Rescheduling Policy
Clients may cancel or reschedule a booking free of charge up to 12 hours before the scheduled ride time.
Cancellations made less than 12 hours before the scheduled ride time may result in the booked session being counted as used and deducted from the client’s package.
French Commute reserves the right to make exceptions in cases of emergencies, illness, unsafe conditions, or unforeseen circumstances.
7. Refund Policy
Session packages are generally non-refundable once partially used.
Refund requests for unused sessions may be considered on a case-by-case basis in situations that reasonably prevent continued participation in the service, including but not limited to:
· serious illness,
· relocation outside the service area,
· extended emergencies,
· or other significant circumstances approved by French Commute.
Approved refunds, if any, may be prorated based on sessions already used and administrative costs incurred.
8. Transportation Risks & Assumption of Risk
Client acknowledges that participation in French Commute services involves transportation by motor vehicle and therefore includes inherent risks, including but not limited to:

traffic accidents,

sudden stops,
-
road conditions,
-
weather conditions,
-
actions of other drivers,
-
vehicle-related incidents,
-
delays,
-
and other unforeseen circumstances beyond French Commute’s control.
Client voluntarily assumes all ordinary risks associated with participation in the service.
Client agrees to comply with all safety instructions, including wearing a seat belt at all times during rides.
9. Release & Limitation of Liability
To the fullest extent permitted by applicable law, Client releases, waives, and discharges French Commute, its owner, operators, contractors, affiliates, and representatives from liability for claims, damages, injuries, losses, or expenses arising out of or related to participation in the service, except in cases of gross negligence, willful misconduct, or liability that cannot legally be waived under applicable law.

French Commute shall not be liable for:

delays caused by traffic or weather,
-
missed appointments,
-
indirect or consequential damages,
-
personal property left in the vehicle,
-
or circumstances outside of its reasonable control.
These Terms & Conditions shall be interpreted in accordance with applicable California law.
10. Insurance
French Commute maintains third-party insurance coverage applicable during scheduled rides. Coverage is subject to the terms, conditions, limitations, and exclusions of the applicable insurance policies.

11. Client Conduct
Clients agree to behave respectfully and safely during all rides.
French Commute reserves the right to refuse, cancel, or terminate rides in situations involving:

unsafe behavior,

harassment,
-
intoxication,
-
illegal activity,
-
threats,
-
damage to the vehicle,
-
or disruptive conduct.
In such cases, sessions may still be deducted from the client’s package.
12. Service Area & Availability
French Commute currently operates within selected service areas and availability may vary depending on scheduling, traffic conditions, operational limitations, and other factors.
French Commute reserves the right to decline bookings outside its operating area.
13. Privacy
French Commute may collect and store booking-related information necessary to provide services and manage client accounts.
By using the service, clients consent to the use of such information in accordance with applicable privacy laws and the French Commute Privacy Policy.
14. Modifications to Services or Terms
French Commute reserves the right to modify services, pricing, packages, availability, or these Terms & Conditions at any time.
Updated Terms & Conditions will be posted on the website and become effective upon publication.
15. Governing Law
These Terms & Conditions shall be governed by and interpreted in accordance with the laws of the State of California.
Any disputes arising from participation in the service shall be subject to the applicable courts located in California, unless otherwise required by law.
16. Acknowledgment & Acceptance
By checking the acceptance box during booking or checkout, Client acknowledges and agrees that:

they voluntarily agree to participate in the service,

they understand that transportation by vehicle involves inherent risks,

they agree to the cancellation and refund policies,

and they voluntarily accept and agree to this Liability Waiver to the fullest extent permitted by law.
